EXPRESSION OF INTEREST FOR A CONSULTANCY TO UNDERTAKE A STUDY AND DEVELOP EAC COMPETITION MERGERS AND ACQUISITIONS REGULATIONS AND GUIDELINES

1.0 INTRODUCTION

The East African Community (EAC) is the regional intergovernmental organisation comprised of the Republic of Burundi, Republic of Kenya, Republic of Rwanda, Republic of Uganda, the United Republic of Tanzania, and the Republic of South Sudan. The Treaty for Establishment of the East African Community was signed on 30th November 1999 and entered into force on 7th July 2000.

The EAC Competition Act came into force in December, 2014 through a gazette notice of 23rd January 2015. The Act seeks, inter alia, to promote and protect fair trade in the Community, ensure consumer welfare and to establish the East African Community Competition Authority (EACA).

The EACA’s mandate is to enforce the Act within the Community and its primary functions include inter alia, analysing mergers and acquisitions, investigating and adjudicating on restrictive trade practices cases, consumer welfare issues and undertaking advocacy in respect of competition and consumer protection issues in the region.

2.0 OBJECTIVES OF THE ASSIGNMENT
The main objective of the assignment is to undertake a study that will inform development of mergers and acquisition Regulations and Guidelines; and, develop merger and acquisition Regulations and guidelines that will steer the Community in having an efficient and effective merger and acquisition regulatory regime in line with international best practices. 2.0 SCOPE OF WORK The assignment will focus on undertaking a detailed study to inform development of mergers/ acquisitions Regulations and Guidelines and development of Regulations and Guidelines to facilitate effective implementation of the mergers and acquisition framework.

3.0 EXPRESSION OF INTEREST
Interested consulting firms may express their Interest by providing the following information in the EOI:-

Qualification, general and specific experience in the field of the assignment over the last 10 years provide a detailed list of similar consultancies previously done in the past five (5) years; provide evidence of at least three previous copies of contracts / orders of similar assignments.

Interested consultancy firms may obtain further information at the address below during office hours 08:00hrs – 16:00hrs (East African Time). No liability will be accepted for loss or late delivery and late submissions will be rejected.
